China has huge patentability on her seeds market development. Before 2000, the state policies for seeds industry only permitted country-level firms doing business in the countrywide. So there was no firms could do the business outside the districts, and the scale of the firms were very small. Nowadays, more than 3,700 firms spread in the nationwide. Several firms became larger scales and they began to contribute to the sale system cross provinces. But comparing with China’s seeds market, their capacity was still tiny. With the ‘commercialization’ in the seeds industry, most firms were still on the primary stage. What we could forecast now was that after 10 years, about 10 large-scale seeds companies would have ability to take 80% markets of the state.

The rules and regulations of seeds industry were improving. “Seeds law of the People’s Republic of China” (issued in 2000) and “Rules for the Regulations of the Peoples Republics of China on Protection of New Varieties of Plants” (issued in 1999) stipulated the particular regulations for seeds industry, at the same time, they supplied a powerful protection of the independence research and development on new species.
